These General Terms & Conditions (“Terms”) govern your access to and use of Apex Community Care’s services, website(s), and communications (including SMS). By using our services or interacting with us, you agree to these Terms.

1) About Apex Community Care

Apex Community Care (“Apex,” “we,” “our,” or “us”) provides community-based services and related support. These Terms apply to visitors, clients, patients (as applicable), caregivers, and any other users of our services.

2) Not Medical or Emergency Services (If Applicable)

Our communications (including texts, emails, and website content) are for general informational and service-coordination purposes and are not a substitute for professional medical advice, diagnosis, or treatment.
 
Do not use SMS to communicate urgent or emergency needs. If you are experiencing an emergency, call 911 immediately.

3) Appointments, Scheduling, and Service Requests

When you request services, schedule appointments, or communicate with Apex, you agree to provide accurate, current information. We may contact you using the information you provide (including by phone, email, or SMS) for scheduling, reminders, and service-related updates.

4) SMS Program Terms

If you opt in to receive text messages, you agree to our SMS Texting Terms & Conditions and SMS Texting Privacy Policy. Message frequency varies. Msg & data rates may apply. You can opt out at any time by replying STOP or UNSUBSCRIBE, and you can request help by replying HELP.

5) User Conduct

You agree not to:
  • Use our services in a way that violates any law or regulation
  • Attempt to interfere with or disrupt our systems or communications
  • Provide false information or impersonate another person
  • Send harmful, abusive, or harassing communications to our staff
We may limit or end communications or access if misuse occurs.

6) Privacy

Your use of our services is also subject to our privacy practices. For SMS communications, please review our SMS Texting Privacy Policy. If Apex provides healthcare services, additional privacy obligations may apply under applicable law (including HIPAA, where relevant).

7) Intellectual Property

Unless otherwise stated, Apex’s name, logos, website content, and materials are owned by Apex or used with permission and may not be copied, modified, or distributed without prior written consent, except as allowed by law.

8) Third-Party Services

We may use third-party providers (such as communication or SMS platforms) to help deliver services. Apex is not responsible for third-party outages, carrier delays, or issues outside our reasonable control.

9) Disclaimers

We provide our services and communications on an “as available” basis. To the extent permitted by law, we disclaim warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement.

10) Limitation of Liability

To the extent permitted by law, Apex will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or communications. Apex’s total liability for any claim will be limited to the amount you paid Apex for the specific service giving rise to the claim, if any, unless applicable law requires otherwise.

11) Changes to These Terms

We may update these Terms from time to time. Updates will be posted with a revised Effective Date. Continued use of our services after changes means you accept the updated Terms.
